Data Analytics. We may third-party service providers to monitor and analyze the use of our Sites. This includes Google Analytics, a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Services. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.
You can opt-out of having made your activity on the Sites available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.
Behavioral Remarketing. We use remarketing services to advertise on third party websites after you visited our Sites. We and our third-party vendors use cookies to inform, optimize and serve ads based on your past visits to our Services. These include:

5. Retention of Personal Information
Infantino will retain your personal data only for as long as is necessary for the purposes set out in this Privacy Policy. The criteria used to determine the retention periods include: (i) how long the personal data is needed to provide the services and operate the business; (ii) the type of personal data collected; and (iii) whether we are subject to a legal, contractual or similar obligation to retain the data (e.g., mandatory data retention laws, government orders to preserve data relevant to an investigation, or data that must be retained for the purposes of litigation or disputes).
Infantino will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer time periods.
6. Security of Personal Information
The security of your personal information is of utmost important to us and we maintain appropriate safeguards to protect it. However, no method of transmission over the Internet, or method of electronic storage, is entirely secure. While we use reasonable practices and procedures to protect your personal information, we cannot guarantee its absolute security. We maintain appropriate technical, administrative, and physical safeguards to secure your personal information against unauthorized access, destruction, loss, alteration, disclosure, or misuse.
7. International Data Transfers
Our Sites are operated exclusively in the United States. We may transfer, store and use information we collect and maintain about you, including personal information outside of your state, province, country or other governmental jurisdiction. The data protection laws in the jurisdiction in which we process personal information may differ from those of your jurisdiction, and in certain circumstances, your personal information may be subject to access requests from governments, courts, law enforcement agencies or regulatory agencies in those jurisdictions. If you are located in the European Economic Area (“EEA”), the United Kingdom (“UK”), or Switzerland, we comply with any applicable laws to provide an adequate level of data protection to the U.S., as described further in the European Privacy Notice. Where applicable law requires us to ensure that an international data transfer is governed by a data transfer mechanism, we use EU Standard Contractual Clauses with data recipients located outside the EEA or the UK as well as other appropriate measures and safeguards.
Infantino will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your personal data will take place to an organization or a country unless there are adequate controls in place including with respect to the security of your personal data.
8. European Privacy Notice
If you are from the European Economic Area (EEA), Infantino’s legal basis for collecting, using, and disclosing the personal data described in this Privacy Policy may depend on the personal data we collect and the specific context in which we collect it. We rely on one or more legal bases to process your personal data under applicable law. We may process personal data (i) as necessary to perform our contractual obligations to you, including, but not limited to, those obligations in our Term and Conditions; (ii) as necessary to pursue our legitimate interests as further detailed below; (iii) as necessary for our compliance with our legal obligations such as a request or order from courts, law enforcement or other government authorities; and/or (iv) with your consent, including to send you marketing email messages and other information that may be of interest to you, which you may withdraw at any time.
Legitimate interests. Where processing your personal data allows us to provide, maintain, and improve our products, services, and Sites. We “sell” / “share” a limited set of personal information that is gather when you visit our Sites, such as cookies and pixels, with third parties in order to allow you to see advertisements, including targeted digital advertisements. We have provided you with information regarding your opt-out rights as described below.

Any request you submit to us is subject to an identification and residency verification process (“Verifiable Consumer Request”) as permitted by the CCPA. We will not fulfill your request unless you have provided sufficient information that enables us to reasonably verify that you are the consumer about whom we collected the personal information on. In order to verify you, you must provide us with your first and last name and email address. These rights are also subject to various exclusions and exceptions under applicable laws.
We will respond to your request within forty-five (45) days after receipt of a Verifiable Consumer Request for a period covering twelve (12) months and for no more than twice in a twelve-month period. We reserve the right to extend the response time by an additional forty-five (45) days when reasonably necessary and provided consumer notification of the extension is made within the first forty-five (45) days.
Authorized Agents. You may also designate an authorized agent, in writing or through a power of attorney, to request to exercise the above rights on your behalf. If you use an authorized agent to exercise your various rights under the CCPA, we may require that you provide your authorized agent with written permission to exercise your various rights and to verify your own identity with us. If your authorized agent does not submit proof that they have been authorized by you to submit verified requests, we reserve the right to deny such a request that we have received and will explain to your authorized agent why we have denied such request.

Household Data. We currently do not collect Household Data. If we receive a Right to Know or Right to Delete request submitted by all members of a Household, we will individually respond to each request. We will not be able to comply with any request by a member of a household under the age of 13, as we do not collect personal information from any person under the age of 13.
Direct Marketing by Third Parties. We do not disclose personal information to third parties for their own purposes, and you may opt-out of any disclosures of non-identifiable personal information. However, because California residents have the right to request information regarding such practices under California’s “Shine the Light” Law, please contact us using the information provided at the end of this Policy. You must include your full name, email address and postal address in your email or mail request so that we can verify your California residence and respond. “Personal information” under this California law means any information that identified, described, or was able to be associated with an individual at the time of disclosure.

We sell”/“share” personal information with third parties to participate in behavioral advertising networks, as those terms are defined by the CCPA. If you wish to opt-out of the “sale” / “sharing” of the limited personal information that is gathered when you visit our Website for purposes of cross-context behavioral advertising by emailing privacy@infantino.com.

10. Virginia Privacy Notice

For purposes of this section, “publicly available information” means information that is lawfully made available through federal, state, or local government records, or information that a business has a reasonable basis to believe is lawfully made available to the general public through widely distributed media, by the consumer, or by a person to whom the consumer has disclosed the information, unless the consumer has restricted the information to a specific audience.

We may collect personal data from or about you as detailed in the first section of this Privacy Policy and in the previous section.
We may collect certain personal data described above which constitutes “sensitive data” as defined under the VCDPA with your consent including:
- Personal data revealing racial or ethnic origin
- Precise geolocation data

We may collect, use, or disclose personal data about you for the purposes detailed in Use of Personal Information above.
c. Who We Share Personal Data With
We limit our disclosure of the categories of personal data above to our service providers for one or more business purposes. “Business purposes” means the reasonably necessary and proportionate use of personal information, in a way that is adequate, relevant, and necessary for specific purposes described in this privacy policy, compatible with the nature and purpose(s) for the collection, use, and retention of the personal data.
We do not “sell” your personal data for monetary consideration as that term is defined under Virginia law.
We share a limited set of personal data that is gathered when you visit our Sites such as cookies and pixels, with third parties in order to allow you to see tailored digital advertisements. You may opt-out of such sharing by following the instructions provided in Notice of the Right to Opt-Out in Section 12(g) above.
d. Your Virginia Privacy Rights
If you are a Virginia resident, you have the following rights under applicable Virginia law in relation to your personal information, subject to certain exceptions:

Any request you submit to us is subject to an identification and residency verification process (“Verifiable Consumer Request”) as permitted by the VCDPA. We will not fulfill your request unless you have provided sufficient information that enables us to reasonably verify that you are the consumer about whom we collected the personal information on. In order to verify you, you must provide us with your first and last name and email address. These rights are also subject to various exclusions and exceptions under applicable laws.
We will respond to your request within forty-five (45) days after receipt of a Verifiable Consumer Request for a period covering twelve (12) months and for no more than twice in a twelve-month period. We reserve the right to extend the response time by an additional forty-five (45) days when reasonably necessary and provided consumer notification of the extension is made within the first forty-five (45) days.
Authorized Agents. You may also designate an authorized agent, in writing or through a power of attorney, to request to exercise the above rights on your behalf. If you use an authorized agent to exercise your various rights under the VCDPA, we may require that you provide your authorized agent with written permission to exercise your various rights and to verify your own identity with us. If your authorized agent does not submit proof that they have been authorized by you to submit verified requests, we reserve the right to deny such a request that we have received and will explain to your authorized agent why we have denied such request.

11. Nevada Privacy Notice
Nevada residents have the right to request to opt out of any “sale” of their personal information under Nevada SB 220. We do not sell your personal information under Nevada law. However, you may nonetheless request to opt out of the future sale of your personal information. If you are a Nevada resident and would like to make such a request, please contact us using the information in the Contact Us section at the end of this Privacy Policy, and provide “Nevada Privacy Rights” in the subject line. You must include your full name, email address and postal address in your request so that we can verify your Nevada residence and respond. In the event we sell your personal information after the receipt of your request, we will make reasonable efforts to comply with such request.
12. Canadian Privacy Notice
This Canadian Privacy Notice provides additional or modifying information on how we manage personal data that we receive from residents of Canada. These rights may be limited in some circumstances by local law requirements.
a. Right to Withdraw Consent
We would like your consent to collect, use and share your personal data for the purposes and in the manner described herein, including in order to contact you and provide you with promotional communications. Nonetheless, we want you to know that you have choices and can refuse or withdraw your consent. In the event that you have already consented to the collection, use and/or disclosure of your personal data, you may subsequently “opt out” at any time, subject to legal or contractual restrictions and reasonable notice, by contacting our Privacy Officer at privacy@infantino.com. Our Privacy Officer will also be able to provide you with more information regarding the implications of withdrawing consent. You may also choose to limit how we use your personal data by not allowing us to share such information with third parties. This may limit some functionalities on our Sites.

You are entitled to request access to, and, if necessary, correct your personal data collected by us, and also to inquire about our privacy practices in general. 14. Children's Privacy
Our Sites are not intended for children under the age of 18.
We do not knowingly collect personal information from anyone under the age of 18.
